1. Acceptance of Terms

By accessing or using Botfy ("the Platform") at botfy.io, you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. These terms apply to all users, including account holders, team members, and end-users who interact with AI agents powered by Botfy.

2. Description of Service

Botfy is an AI-powered sales automation platform that enables businesses to create and manage conversational AI agents across messaging channels (WhatsApp, Telegram, web chat). The Platform includes features such as:

• AI agent creation with custom knowledge bases
• Multi-channel messaging integration
• CRM and lead management
• Google Calendar scheduling integration
• Media catalog management
• Usage analytics and reporting

3. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your credentials and for all activity under your account. Each account is associated with a single tenant (company). You must notify us immediately of any unauthorized access.

4. Plans & Billing

Botfy offers the following plans: Free, Starter, Growth, Business, and Enterprise. Each plan has usage limits for agents, messages, storage, and media items. Exceeding your plan's limits may result in restricted functionality until you upgrade.

Paid plans are billed monthly or annually via Stripe. You may cancel at any time; your access continues until the end of the billing period. Refunds are handled on a case-by-case basis.

5. Acceptable Use

You agree not to use the Platform to:

• Send spam, unsolicited messages, or engage in phishing
• Distribute malware or harmful content
• Impersonate another person or entity
• Violate any applicable law or regulation
• Reverse-engineer, scrape, or attempt to extract source code
• Circumvent usage limits, authentication, or security measures
• Use AI agents to generate misleading, defamatory, or illegal content

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

6. Intellectual Property

The Platform, including its design, code, and AI models, is the property of Botfy AI. You retain ownership of the content you upload (knowledge base documents, media files). By uploading content, you grant us a limited license to process it for the purpose of providing our services.

7. Third-Party Integrations

The Platform integrates with third-party services including Google Calendar, Telegram, WhatsApp, OpenAI, Supabase, and Stripe. Your use of these integrations is also subject to their respective terms and privacy policies. We are not responsible for the availability or behavior of third-party services.

8. AI-Generated Content

Responses generated by AI agents are produced by large language models and may not always be accurate. You are responsible for reviewing and validating AI-generated content before relying on it for business decisions. Botfy does not guarantee the accuracy, completeness, or fitness of AI responses for any particular purpose.

9. Limitation of Liability

To the maximum extent permitted by law, Botfy AI shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

10. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to notify users in advance of planned downtime.

11. Termination

You may close your account at any time by contacting us. Upon termination, your data will be deleted in accordance with our Privacy Policy. We may terminate or suspend your account for violation of these terms.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered users. Continued use of the Platform after changes constitutes acceptance of the new terms.

13. Governing Law

These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes shall be resolved in the courts of São Paulo, SP, Brazil.
